On 28th<\/sup> of March 2024 the National Convention on the European Union in the Republic of\u00a0 North Macedonia (NKEU-MK) has held the Thirteen session of the working groups on topics regarding the negotiating chapters for Justice and Fundamental rights (Chapter 23) and Justice, freedom and security (Chapter 24) entitled: \u201e<\/strong>Fundamental rights, justice and freedom through the prism of the Mechanism of the EU rule of law<\/strong>\u201c<\/strong>.<\/p>\n

The dialogue within the session was focused on the questions of the new Mechanism for the EU rule of law as a new challenge and tool to follow and overcome the weaknesses of the democratic capacity of the institutions in regards to adoption and implementation of the laws.<\/p>\n

The Mechanism which is significant for the members-states of EU, but also for negotiating states. \u00a0This new approach of EU for including the Western Balkan states in work of many EU institutions, among which the Mechanism for the rule of law already has positive impulses in euro-integration process in regional frames.<\/p>\n

At the session, the national coordinator of NKEU-MK and president of the European movement in Republic of North Macedonia, Mileva Gurovska<\/strong> had the introduction, emphasizing the importance of the topic in regards to the latest developments in the country connected to the rule of law and importance of the Mechanism for the EU rule of law and giving contribution for improvement of the actual condition in this area.<\/p>\n

The coordinator for the Working group 3, the professor from the Law faculty \u201cIustinianus Primus\u201d Aleksandra Deanoska-Trendafilova<\/strong> gave chronological illustration of the development of Mechanism for the EU rule of law and which conclusions would be useful for our country in this area.<\/p>\n

She gave focus on the EU progress reports which address the rule of law in the member-states and concern the following of the situations in different parts of the rule of law, including: systematic problems in the process of adopting laws, implementation of the laws by the executive power, lack of effective judicial protection or disrespect of the principle for dividing the power.<\/p>\n

Monitoring checks also the capacity of the member-states in regards to fighting corruption, media pluralism, the capacity of the institutions for implementation of the law, and the aim is to raise the consciousness, to reveal risks from the violation of the rule of law and to secure the support from the very beginning. Rule of law is condition that is constantly being reviewed and scored by the EU, so even when we become members state and in this moment it is necessary to learn from the states that receive remarks and are similar to our system so that we can act proactively in creating policies.<\/p>\n

At the session, the expert on the rule of law, Kristijan Turkalj, who was the main negotiator in the negotiating team of Republic of Croatia for the Chapter 23\u2013Judiciary and basic rights and Chapter 24-Justice, freedom and security shared experiences from the accession negotiations of Republic of Croatia on the way to EU membership. He emphasized the importance of the Chapters 23 and 24 in the whole process.<\/p>\n

If there is will, it is necessary for all forces to focus on these two chapters because the whole integration process is depending on them. It is essential for a consensus of the political elites and clear negotiating frame to be made, which will insure timely and securely bringing of the necessary decisions. According to him, the reports and perceptions for the rule of law which are sent to European commission are of important significance and therefore all actors must cooperate and act in the negotiating process. As requests that came out from the Chapters 23 and 24, Croatia had to make changes in its\u2019 Constitution in the direction of adjusting Croatian laws in regards to the European. Bringing decisions for tough questions is crucial in the negotiating process, still, the benefits of the full EU membership should always be in mind.<\/p>\n

Trpe Stojanovski<\/strong>, NKEU-MK expert and professor from the Faculty for security in Bitola emphasized the importance of the rule of law and the division of the powers because only through that control among institutions can be secured as well as functioning of the state system.<\/p>\n

Efficient public administration is needed which will be the basis of the rule of law. Additionally, coordination of the political elites in regards to European path is crucial, as well as putting aside the party whishes in the process of bringing laws, illustrating this through the example of the reports for misuse of the \u201ceuropean flag\u201d by the legislators.<\/p>\n

The director of the Institute for European politics-Skopje, Simonida Kacarska<\/strong> has emphasized the importance of the Mechanism for the EU rule of law, especially for candidate countries such as Republic of North Macedonia, which has stayed too long in the EU waiting room, because by this the country has the possibility to be in touch with actual events in the field of the EU rule of law, as well as to measure itself with european standards and to take over the reforms whereas is needed.<\/p>\n

Bojana Bosilkova<\/strong>, chief of the Department for negotiations and integrations, coordinator of the Working group for the Chapter 23 in the Ministry of justice of Republic of North Macedonia and Bekim Regepi<\/strong>, chief of the Sector for negotiations and integration, Department for EU and international cooperation In the Ministry of interior of the Republic of North Macedonia talked about the activities that are being undertaken by the state in regards to Rule of law and the requests that come out of the negotiating process and address the Chapters 23 and 24.<\/p>\n

The project National Convention on the European Union in Republic of North Macedonia is a platform for including civil sector for debates in regards to topics connected to European integration process so that all capacities of the state to be prepared for the upcoming negotiating process with EU. The project is being realized by the European movement in Republic of North Macedonia and is financed by the EU Delegation in Republic of North Macedonia and SlovakAid.<\/p>\n
