{"id":818,"date":"2018-07-16T07:43:11","date_gmt":"2018-07-16T07:43:11","guid":{"rendered":"http:\/\/nkeu.mk\/?p=818"},"modified":"2023-09-28T07:31:15","modified_gmt":"2023-09-28T07:31:15","slug":"recommendations-from-the-second-session-of-working-group-4-asylum-international-and-temporary-protection","status":"publish","type":"post","link":"https:\/\/nkeu.mk\/en\/2018\/07\/16\/recommendations-from-the-second-session-of-working-group-4-asylum-international-and-temporary-protection\/","title":{"rendered":"Recommendations from the Second session of Working Group 4:  &#8220;ASYLUM \u2013 International and temporary protection&#8221;"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>NATIONAL CONVENTION ON THE EUROPEAN UNION IN THE REPUBLIC OF MACEDONIA<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/strong><strong>Second Session of Working Group IV \u2013 Justice, freedom and security: <\/strong><\/p>\n<p style=\"text-align: center;\"><strong><em>\u201e<\/em><\/strong> <strong>ASYLUM \u2013 International and temporary protection<\/strong><strong><em>\u201c<\/em><\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Skopje, 21<sup>th<\/sup> June 2018<\/strong><\/p>\n<p style=\"text-align: center;\"><b>RECOMMENDATIONS<\/b><\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Legislative compliance with the EU regulation is made to a significant extent by the new Law on International and Temporary Protection (April 2018), but further harmonization of other laws and by-laws is also necessary. Full harmonization of the bylaw with the Law on International and Temporary Protection is recommended.<\/li>\n<li>In the implementation of the EU Regulations and Directives related to the refugee and migrant crisis, it is recommended proper balance between the two values: protecting the human rights of the person and guaranteeing the security of the state.<\/li>\n<li>It is recommended to follow European policies in the development and implementation of the Safe Third Country Concept. It is necessary in a regular procedure to investigate why the person has left the country of origin and residence, with full argumentation of the reasons. The basis If the person arrives from a safe third country in which the person could apply for asylum, except if the person successfully argues that the third country is not safe, urgent procedure in the part of unallowed requests. The proposal for execution of these requests in regular procedure in not in accordance with the Law nor the EU directives.<\/li>\n<li>The State institutions to provide indiscriminate access to the right to asylum procedures, as well as to protective mechanisms that should include access to legal aid, doctor, and the possibility of contact with the family.
